Court denies proposed rule that would regulate decorative hearths

A federal appeals court recently rejected a proposed rule by the Department of Energy that would have imposed a minimum efficiency standard on decorative hearth products such as gas fireplaces and gas log sets. The National Propane Gas Association and the Hearth, Patio & Barbecue Association argued that no method can measure the products' minimum efficiency, as they were not built for direct heating.
