Drugmakers to Ala. court: Reconsider generic-drugs decision

PhRMA, the U.S. Chamber of Commerce and other organizations are asking the Alabama Supreme Court to reconsider a ruling that makes brand-name drugmakers liable for injuries caused by generic versions of treatments. "By essentially absolving [generic-drug-makers] of any responsibility, you're saying they don't have to perform that job very carefully," PhRMA General Counsel Mit Spears said. A 2011 U.S. Supreme Court case that protected makers of generics left the Alabama court with few options, said John Fuson, a former FDA associate chief counsel.
