There are some instances where you can fire an employee who is on leave under the Family and Medical Leave Act, such as if the worker would have been fired anyway, Cynthia Hsu writes. "If you need to fire an employee on FMLA leave for performance-based reasons, keep track of all the related documents," Hsu writes. "You may also want to consult an employment attorney."
