Court dismisses EDF's wind-farm suit against Xcel

U.S. District Judge Michael Davis dropped EDF Renewable Energy's lawsuit against Xcel Energy on April 4. Xcel had terminated its $400 million deal with EDF after the proposed wind farm was considered a potential risk to two protected bird species. Davis said EDF's inability to promptly secure a state site permit, which was only obtained in June 2011, gave Xcel the right to cancel its deal at the drop-dead date of March 31, 2011.
