Reliance on practitioner's mistaken advice leads to large late-filing penalty

The Ninth Circuit Court of Appeals held that an executor whose accountant gave him mistaken advice about the extended due date for filing an estate tax return was liable for a large late-filing penalty, despite his reliance on the accountant's mistake. The court said it was not reasonable for the executor to rely on the accountant for advice about the due date, a question of fact.
