A U.S. district judge has dismissed a $147 million lawsuit against Goldman Sachs Group brought by Capmark Financial Group. The suit stems from Capmark's assertion that Goldman used its influence to get the lender to refinance $1.5 billion in unsecured debt. In an earlier bankruptcy case, Capmark said "that the secured credit facility was negotiated at 'arm's length,' " according to the judge. "Plaintiffs now assert a claim that requires the secured credit facility to have been a non-arms-length transaction."
