Attorney: Some courts may view infectious agents as pollution

Infectious-disease outbreaks may fall under the pollution exclusion of commercial general liability, professional liability and other insurance policies, potentially hindering medical facilities in getting coverage for such events, attorney John Pollom writes. Courts have a wide range of interpretations of the exclusion, however, making it incumbent upon medical facilities and insurance companies to understand whether a local jurisdiction takes a narrow or broad view, Pollom writes.
