David Dayen writes that Newark, N.J., was hit hard by the foreclosure crisis, prompting politicians and activists to consider using eminent domain to seize and renegotiate mortgages. "[T]he way eminent domain has been envisioned, especially by the well-connected company trying to sell many cities on the idea, is legally dubious and incredibly risky for the municipality," Dayen writes.
