Draft guidance issued last month by the Environmental Protection Agency could require manufacturers, developers and other potential buyers and sellers of Superfund and Resource Conservation and Recovery Act sites to step up the evaluation and handling of vapor intrusion, write attorneys Maureen Brennan and Martin Booher of Baker & Hostetler. The authors describe the potential steps and costs for sampling and investigating sites for vapor intrusion, as well as remedial actions that may be taken.
