Appeals court vacates $4M award for lost profit

The U.S. Court of Appeals for the 4th Circuit has rejected expert testimony as unreliable in a defamation case involving statements by a payment processor in connection with a plaintiff company's launch of a prepaid gas program. The court faulted methodology in calculating lost profit by the plaintiff's marketing expert and rejected the forensic-accounting expert's testimony as flawed because it was based on the marketing expert's projections.
