Insurer must cover legal fees in Clean Air Act case, court rules

A power company's insurer is required to pay for the cost of the firm's defense against the Environmental Protection Agency's allegations of Clean Air Act violations, a federal appeals court has ruled. The insurance policy's "pollution condition" was triggered with the EPA's claim of excessive emissions by the company, according to the court.
