Ohio must recognize same-sex married couple, judge rules

Ohio must recognize a marriage performed in Maryland that joined two gay men, one of whom is terminally ill, a federal judge has ruled. "The end result here and now is that the local Ohio Registrar of death certificates is hereby ORDERED not to accept for recording a death certificate for John Arthur that does not record Mr. Arthur's status at death as 'married' and James Obergefell as his 'surviving spouse,' " Judge Timothy Black wrote, noting that Arthur is certain to die soon. Black said the state's refusal to recognize same-sex couples legally married elsewhere likely violates the U.S. Constitution.
