Ruling in Colo. fracking case may benefit some toxic-tort plantiffs

A Colorado appeals court decision has made it easier for a small group of property owners to bring a toxic-tort case. In a reversal of a trial court's decision to dismiss the case, the appeals court ruled that four family members didn't have to provide prima facie evidence before the discovery process to support their claims of exposure because of hydraulic fracturing.
