California AG: Today's marriages legal, even if ban approved in Nov.

California Attorney General Jerry Brown believes marriages of same-sex couples conducted through the Nov. 4 election would be legally valid, even if voters approve a constitutional marriage ban, which does not address the issue of retroactivity. "I would think the court, in looking at the underlying equities, would most probably conclude that upholding the marriages performed in that interval [before the election] would be a just result," Brown said.
