Case against CBOE and OCC can move forward, Ill. court rules

An appeals court in Illinois ruled that a case brought by Platinum Partners Value Arbitrage Fund against CBOE Holdings and Options Clearing can proceed. A trial court had dismissed the case, which alleges that the exchange sent information to some traders. "Where defendants privately disclose information about the price adjustment of ... stock options to selected market participants before the information is made publicly available, the doctrine of regulatory immunity does not apply," the appellate court said.
