Same-sex couples are covered by ERISA regardless of residence, DOL says

The Department of Labor has ruled that same-sex married couples are to be included in the Employee Retirement Income Security Act of 1974, or ERISA, and other employee benefit laws over which the department has jurisdiction. The department also said that this interpretation applies no matter where an employee and his or her same-sex spouse reside.
