Claim doesn't meet conditions for pollution buyback, court rules

A federal court in Oklahoma has ruled against a company that argued for coverage under a pollution buyback endorsement of its primary general liability policy. The terms of the policy don't allow for coverage of the waste materials in question, the court found. The company, Bear Products, is a defendant in a class-action lawsuit that alleged property damage and personal injury related to hydraulic fracturing fluids, which the company had transported.
