Federal court rejects FAA's "no hazard" ruling on Cape Wind

A federal appeals court ruled against the Federal Aviation Administration's determination that the Cape Wind project in the Nantucket Sound presents "no hazard" to passing aircraft. "The FAA did misread its regulations, leaving the challenged determinations inadequately justified," the panel of judges said. Cape Wind spokesman Mark Rodgers said that "the FAA has reviewed Cape Wind for eight years and repeatedly determined that Cape Wind did not pose a hazard to air navigation."
