Ill. court: Noncompete agreements require proof of business risk

In order to enforce a noncompete agreement, Illinois employers must demonstrate that a departing employee poses a legitimate business risk by accepting a position at a rival company, the state's Supreme Court has ruled. The decision reversed a lower-court decision saying that noncompete agreements can be limited only by time and geographic considerations.
