A California appellate panel ruled that the city of Manhattan Beach should have made an environmental impact report before issuing an ordinance in 2008 to ban plastic bags. The Save the Plastic Bag Coalition cited the California Environmental Quality Act to defeat the city's ordinance. A ban on plastic bags would only increase the use of paper bags, which produce two to three times more carbon emissions than plastics, said Stephen Joseph, the group's counsel.
