The U.S. Court of Appeals for the District of Columbia Circuit heard arguments on the legality of
a federal mandate requiring graphic warnings on tobacco packs and ads.
The FDA asked the court to overturn a ruling that its policy violates manufacturers' rights to free speech. "Adolescents notoriously underestimate their ability to resist addiction," Mark Stern of the Justice Department said. "Do (these labels) accurately and realistically depict the message that this is really addictive? Yes, (they) do."
