The Federal Energy Regulatory Commission's ruling giving wind power developer PWEC priority rights to use capacity in interconnection facilities owned by affiliate Peetz Logan Interconnection effectively ends the agency's policy of requiring a transfer of ownership before granting such rights. The condition "was to ensure that arrangements between affiliates did not undermine open access," FERC said. "[T]he commission now concludes that the showing required to establish priority rights addresses our open access concerns and thus it is no longer appropriate to require a transfer of ownership as a condition for granting priority rights to the generation developing affiliate of a transmission owner."
