California's Proposition 8 is unconstitutional because it discriminates against same-sex couples, according to a brief filed at the Supreme Court on Thursday by the Obama administration. If the court agrees with the administration's argument, it could strike down laws in California and seven other states that grant legal benefits to same-sex couples without allowing them to marry. The brief does not argue that all state bans on same-sex marriages are unconstitutional. Oral arguments in the case are set for March 26.
