The Supreme Court will hear arguments today about whether generic-drug makers can be held liable for alleged flaws in the designs of drugs. The Generic Pharmaceutical Association said "if jurors with no technical expertise can decide health care matters like what is medically safe for patients, the result will be an unpredictable flow of needed medicines." Former HHS official Tevi Troy writes that letting jurors second-guess the FDA will make it harder to bring life-saving drugs to patients.
