The U.S. Supreme Court ruled 7-1 in favor of the Environmental Protection Agency's exemption of logging-road runoff from the Clean Water Act permitting process. Justice Anthony Kennedy wrote in the majority opinion that the EPA "could reasonably have concluded that further regulation in this area would be duplicative or counterproductive" because of state regulation of logging roads. The Oregon environmental group that challenged the EPA policy plans to continue its litigation, the group's attorney said.
