The Justice Department filed a brief seeking to block a lower court judge's ruling allowing the sale of the Plan B emergency contraceptive to women of all ages without a prescription. The decision by Judge Edward Korman concluded that the FDA can't implement age limits for the sale of Plan B. "Although the district court rejected the government's position in the strongest terms, the court plainly exceeded its jurisdiction," the Justice Department said in the appeal.
